Description: Now more than ever, employees are engaging in off-duty conduct that impacts the workplace. From attendance at political rallies and social movements, posting on social media, and other outside conduct, employees’ activities are often on display for all to see. Whether the conduct paints the employer in a bad light, makes co-workers or customers uncomfortable, causes COVID-19 exposures or simply causes the employer to question whether to continue the individual’s employment, employers must keep in mind the myriad of laws, policies, business considerations and media attention that come into play when addressing outside activities. This program will give employers a roadmap for analyzing the legal, business and media risks associated with off-duty conduct by employees.
 
Presenter Bios  
 
William J. Anthony focuses his labor and employment practice on class, collective, and multi-party actions, including a broad spectrum of federal and state law wage and hour claims. He has successfully defended against actions alleging misclassification of independent contractors, misclassification of employees, “off the clock” work, failure to properly calculate the regular rate of pay, and similar claims. He also has defended class claims under the Fair Credit Reporting Act and discrimination statutes. In addition, Will represents organizations in single-plaintiff cases alleging discrimination, harassment, wrongful termination, and breach of contract.
 
Will has litigated cases in over fifteen states and has trial experience in Connecticut, New Jersey, Tennessee, Pennsylvania, and Montana. His trial experience includes defense of class, collective and single plaintiff actions before juries, judges, and arbitrators.
 
Will has extensive experience advising clients on the full range of employment law issues and provides training on management skills, discrimination, harassment, and wage and hour laws. He is a frequent speaker on employment law topics in front of a broad range of live and remote audiences.
 
Brooke Iley counsels and defends domestic and foreign corporations in all areas of employment and labor law compliance and litigation, including wrongful termination, discrimination, harassment, wage and hour class and collective actions, trade secret disputes and data protection, and alleged fiduciary breaches. She represents clients in negotiations, litigations, and arbitrations nationally in these areas.
 
Brooke also creates compliance, internal audit, and investigation programs to support public and private company operations, workforce management, and corporate governance. Through proactive management training programs and thoughtful review of corporate programs and policies, Brooke is successful in limiting employers’ exposure to legal actions, and increasing workplace efficiencies and retention.
 
She is a trusted adviser to companies, providing practical and proactive risk management advice, such as drafting and negotiating key executive agreements, restrictive covenants agreements, and providing employment law knowledge during transactions related to due diligence, purchase agreements, employee transfers, and workforce management.
 
Brooke is a member of Blank Rome's Diversity & Inclusion Committee, Lateral Recruiting Committee, Strategic Planning Committee, Strategic Plan Implementation Committee, and is Chair of the D.C. Women's Forum.
 
Asima Ahmad concentrates her practice on labor and employment litigation and counseling. She has experience representing clients in state and federal court, arbitration, and before administrative agencies in a broad range of employment matters, including:
 
  • discrimination, retaliation, sexual harassment, and wrongful termination
  • wage and hour violations
  • enforcement and defense of non-compete and non-solicitation agreements
 
Asima regularly provides preventative counseling and trainings to clients to minimize risk and limit legal exposure. In addition, Asima routinely drafts and negotiates restrictive covenant agreements, employment agreements, employment policies and handbooks, and separation and release agreements.  Asima also performs labor and employment transactional due diligence and risk assessment in the context of a sale or acquisition.
 
During law school, Asima served as managing editor of articles for the Penn State Journal of Law and International Affairs, and was a member of the Civil Rights Appellate Clinic, where she received the CALI Excellence for the Future Award. Asima led the clinic’s efforts in researching and writing an amicus brief filed with the United States Supreme Court in a Title VII retaliation case on behalf of twenty civil rights and advocacy groups. Additionally, she served as a legal intern for the Legal Aid Society in Jamaica, New York.
 
Asima is fluent in Urdu.
