Description: Before the pandemic of 2020, contested custody disputes over how decisions are to be made between divorcing parents could generally be segregated into two buckets: (1) the “major” decisions, such as where to enroll a child in school, medical treatment, or whether or not to have a child treated by a therapist; and (2) the “routine daily decisions” – a sacred collection of day-to-day decisions that a divorced parent could make on his or her own without needing to seek the consent of the other parent.
 
After the Covid-19 outbreak, the once, seemingly defined bucket of “routine daily decisions” has become a gray area. New York courts faced with making a determination about custody must consider the “best interests of the child”. Making that determination after the pandemic presents a host of new challenges. What was once taken for granted – taking your child to socialize with a friend, taking your child to school, or just grabbing a bite with your child has transformed into a mine field of complexities that might impact a custody proceeding. With that in mind, is there a way out, or a means to find solutions to mitigate these complexities in contested custody proceedings, or is expanded conflict over matters that were once considered “routine” simply going to be the norm following the pandemic? Our panelists look forward to sharing their views on these evolving topics.
 
Presenter Bios  
 
 
Alan Feigenbaum is an experienced matrimonial and family law attorney who assists a diverse range of professionals and their spouses, including business owners, lawyers, investors, and entertainers, on their family law matters, with a notable focus on evaluating the optimal strategies to manage and resolve complex financial and custody disputes.
 
He is well-versed in managing agreements (separation, prenuptial, and postnuptial) to create a framework for his clients’ futures, and approaches dispute resolution with an eye toward facilitating cooperation and reducing conflict, making every effort to settle cases out of court.
 
Understanding that divorce can affect the trajectory of a person’s life, Alan focuses on his clients’ long-term financial and familial best interests. His multifaceted approach has included:
 
  • Working with financial experts to identify and define the scope of assets acquired by a spouse before the marriage, thereby eliminating litigation over whether those assets are part of the marital pot;
  • Resolving the disposition of a spouse’s interest in a business without resorting to a pro forma approach that assumes complex valuation of that interest is always required;
  • Reaching agreement on the payment of expenses while a divorce action is pending, without the need for costly, interim support motion practice;
  • Negotiating interim parenting schedules by empowering parents and not substituting attorney judgment for that of the parents;
  • Settling contentious custody disputes without involving court-appointed professionals, sparing the family from the potentially lasting effects of domestic relations litigation; and
  • Prioritizing the value clients place on financial independence both during and after the divorce action concludes, including in the case of the nonmonied spouse evaluating the financially feasibility of retaining the marital home.
 
Alan also has significant courtroom experience, including first-chair trial experience in domestic relations matters and, at an early stage in his career, examining witnesses before the U.S. International Trade Commission. He also speaks and writes frequently on matters of family law.
 
Nikki Bruno, EdM, is a divorce empowerment coach and the founder of The Epic Comeback™ (www.theepiccomeback.com). Her experience of reclaiming her power after a high-conflict divorce inspired her to help others do the same. Bruno is a thought leader on high-conflict divorce, emotional abuse, intuition, and mompreneurship. She is also a 20-year veteran of the publishing industry and a published author. Bruno holds a bachelor’s degree in anthropology from Princeton University, a master’s degree from the Harvard Graduate School of Education, and coaching education and training from iPEC. She has been featured on ABC, NBC, and ABC News and in Forbes, Reader’s Digest, Authority Magazine, the Houston Chronicle, Best Self, Cosmopolitan, Bustle, and Glassdoor. A single mom of two, Bruno loves scuba diving, traveling, and helping women (re)discover how incredible they are.
 
Sophie Jacobi-Parisi is a partner in the Matrimonial Group at Warshaw Burstein, LLP in New York and also holds a Masters in Social Work.
 
She concentrates her practice in all areas of matrimonial and family law.
 
Ms. Jacobi-Parisi is experienced handling complicated custody cases, including custody matters involving children with special needs. She negotiates prenuptial, separation and settlement agreements, and has trial and litigation experience in New York’s Family and Supreme courts.
 
Prior to joining Warshaw Burstein, Ms. Jacobi-Parisi was a partner at a premiere boutique matrimonial firm. Prior to that. Ms. Jacobi-Parisi was a staff attorney with the Legal Aid Society, Juvenile Rights Practice, where she represented children in legal proceedings in the Bronx Family court.
