Description: How can law firms and in-house legal departments deepen their analysis of litigation by reframing it from a cost to an investment? This framing has implications for what litigation to pursue, how to select counsel, when and for how much to settle, and how to measure success. The program will also give an introduction to litigation modeling.

Ashton Batchelor leads trial law firm Robins Kaplan LLP’s pricing, Legal Project Management (LPM), and financial analytics functions.
 
Drawing upon her extensive experience working in litigation, Ashton helps create innovative and practical fee arrangements ranging from simple fixed fees to complex shared risk arrangements. Ashton also supports attorneys and clients through the firm’s sophisticated diligence process for risk-based arrangements to ensure these arrangements are based upon shared assumptions and terms of success. In addition, Ashton partners with Robins Kaplan’s executive board and leadership team to manage the firm’s portfolio of risk-based arrangements.
 
Ashton oversees Robins Kaplan’s matter management program, including an in-house team of certified legal project managers who partner closely with firm clients to effectively scope, budget, and manage legal matters from inception to result. These efforts help provide transparency and predictability in costs in the delivery of legal services.
 
Ashton also oversees a team of financial analytics professionals who support the economics behind each of Robins Kaplan’s practice groups, working closely with firm management, practice group leaders, and office leaders to support revenue management and identify opportunities for greater efficiency.
 
Joshua Libling - As Portfolio Counsel in Validity’s New York office, Joshua works closely with clients and other investment team members to evaluate cases and identify funding solutions that work for a variety of complex litigation scenarios. Joshua is a member of the Minorities in the Profession Committee for the New York City Bar Association.
 
Prior to joining Validity, Joshua was Counsel and Pro Bono Coordinator at Boies Schiller Flexner where his practice centered around complex commercial and appellate litigation. Joshua has broad experience in antitrust and securities suits, government investigations (for both private and government clients), contract disputes, and multistate class actions. He has been involved in some of the country’s highest profile and highest stakes litigation and has worked extensively on appellate matters before the U.S. Supreme Court, the U.S. Court of Appeals for the Second and Fifth Circuits, the New York First and Second Departments, and the Superior Court of Pennsylvania.
 
Joshua received his J.D. magna cum laude, Order of the Coif from New York University School of Law, where he was a Furman Scholar and an Allen Scholar, as well as an Article Editor for the Annual Survey of American Law. He earned his B.A. in Philosophy with General Honors from the University of Chicago.
 
Joshua served as law clerk to the Honorable Chester J. Straub, U.S. Court of Appeals for the Second Circuit and to the Honorable Kenneth M. Karas, U.S. District Court for the Southern District of New York.
