Description: This program will provide an overview of employers’ payroll tax obligations (including the duties to collect and pay over) and the increased focus on criminal enforcement by the Department of Justice (DOJ), as well as civil enforcement by the Internal Revenue Service (IRS).
 
Attendees will learn:
  • common examples of non-compliance through recent civil and criminal cases;
  • potential sanctions for noncompliant companies, along with their officers and directors;
  • voluntary disclosure strategies and attendant risks;
  • when non-compliance crosses the threshold and becomes a criminal matter;
  • recent changes to payroll tax obligations in response to COVID-19.
 
Presenter Bios  
 
Carolyn H. Kendall is a Principal in the Firm's Internal Investigations & White Collar Defense and Health Care Practice Groups. She conducts internal investigations and defends corporations, officers, and other individuals facing criminal and civil investigation. Her practice includes matters involving pharmaceutical, manufacturing, and financial companies, relating to potential criminal tax and money laundering violations, as well as allegations involving securities violations, mortgage, and financial institution fraud, the Federal Anti-Kickback Statute and Stark Law, and other fraud and regulatory statutes. She also assists clients in offshore account disclosure and compliance via IRS disclosure programs (OVDP and Streamlined Procedures). The Best Lawyers in America recognized Ms. Kendall in its 2021 edition in the "Ones to Watch" category in the area of Criminal Defense: White-Collar. In 2018, 2019, and 2020, she was selected by her peers as a Pennsylvania Super Lawyer Rising Star in the category of Health Care. She is also co-author of the 2014 Cumulative Supplement to the treatise titled Criminal Tax, Money Laundering, and Bank Secrecy Act Litigation (Bloomberg BNA 2010).
 
James R. Malone, Jr. is a Principal in the Firm’s Tax Controversy Practice, representing clients in disputes with federal, state, and local tax authorities in both administrative proceedings and in court. His clients include businesses, non-profits, individual taxpayers, accountants, and tax preparers. In federal tax matters, Mr. Malone represents clients before the Internal Revenue Service and in the U.S. Tax Court, the U.S. Court of Federal Claims, or U.S. District Courts. For state and local tax matters, Mr. Malone represents clients before the Department of Revenue, before local administrative agencies and in the Pennsylvania courts. The Best Lawyers in America, a peer-reviewed publication, selected him for inclusion in its most recent 2021 Edition in the categories of Litigation and Controversy - Tax and Commercial Litigation. In 2019, he was honored as a member of the Irish Legal 100. Mr. Malone is a member of the Tax Council of the Philadelphia Bar Association and of the State and Local Tax Committee of the Philadelphia Bar Association’s Tax Section. He is also active in the Tax Section of the American Bar Association, where he has contributed to policy comment projects as a member of the Administrative Practice Committee.
