Marc Hirschfield EMPOWERED ambition when he served as one of the lead attorneys to the trustee for the Bernard l. Madoff investment securities ponzi scheme where he oversaw more than one thousand litigations.
Marc was personally involved in negotiating settlements where the Trustee collected more than $8 billion, all of which was paid to the victims of Madoff's crimes.
Marc Skapof EMPOWERED ambition when he leveraged his experience representing borrowers, lenders and distressed investors to educate an energy client on the business motivations and concerns of investors in a bond exchange offering and helped negotiate company-favorable terms during one of the most drastic declines in oil and gas prices in history.
Through an in-depth industry experience and knowledge of how distressed investors differ from traditional lenders and institutional investors, he aided the client in closing a complex financing transaction on an accelerated time-frame while also counseling on how distressed investors view a company's capital structure as a means to achieve above-average returns and arbitrage opportunities in non-traditional ways.
Program Description:
The COVID-19 pandemic threatens both the public’s health and the health of the economy, causing record unemployment and seismic dislocations in many business sectors and industries. The pandemic has hit small businesses especially hard and a it remains unclear exactly how long the economic downturn will last. For many business people and their attorneys, this may be their first experience navigating a recession but in any event, since it has been quite a while since the last downturn, it is important to review.
This program will explore what businesses should think about if they are facing financial distress and what they can do to mitigate these issues (including a discussion of the newly enacted small business bankruptcy law). We will also explore what to think about if a company’s counterparties are facing financial distress. Finally, we will discuss how the economic downturn also provides opportunities for companies to acquire assets at discounted prices through non-traditional or distressed M&A-type transactions.
