Description: During this program, attendees will learn about the rapidly evolving legal environment related to the novel coronavirus, COVID-19, and its impact on the American workplace. Attendees will learn about: complying with federal/state non-discrimination laws while simultaneously protecting the health and safety of all employees; the proper way to pay exempt/non-exempt employees while on leave; managing leaves of absence; preserving employee confidentiality in the event an employee is diagnosed with COVID-19; implementing a telecommuting program; travel restrictions; and changes to employee working conditions. The presenters will also provide an overview of recently enacted and pending legislation designed to ameliorate the effect of COVID-19 on workers.
 
Susan K. Lessack is a partner in the Berwyn and Philadelphia offices of Pepper Hamilton LLP. She concentrates her practice in employment counseling and employment litigation. Ms. Lessack’s experience includes counseling employers on matters related to compliance with federal and state employment laws, including hiring, discipline, medical leaves and separations; conducting investigations of employee conduct, including harassment; negotiating and drafting employment and separation agreements; and developing employment policies. She defends employers in litigation of employment discrimination claims, wrongful discharge claims, and claims under federal and state employment-related statutes such as the Family and Medical Leave Act, the Fair Labor Standards Act and state wage payment and collection laws.
 
Ms. Lessack writes extensively about developments in employment law and also speaks on various issues in employment law, including harassment, discrimination and performance management.
 
Lee E. Tankle is an associate in the Labor and Employment Practice Group of Pepper Hamilton LLP, resident in the Philadelphia office. Mr. Tankle litigates complex employment claims under federal and state laws including the Fair Labor Standards Act (FLSA), Title VII of the Civil Rights Act of 1964 (Title VII), the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and the Pennsylvania Human Relations Act (PHRA).  Mr. Tankle represents a broad spectrum of employers before state and federal courts and administrative agencies, including the Equal Employment Opportunity Commission (EEOC) and state fair employment practices agencies.
 
Mr. Tankle also provides clients with day-to-day employment counseling related to workplace issues including hiring, discipline, harassment and discrimination, medical leaves, and disability accommodations.  In an effort to help employers avoid litigation and position them as strongly as possible when claims do arise, Mr. Tankle works with clients to develop and update employment policies and comprehensive employee handbooks.  He also advises on a number of other personnel issues including development and enforcement of non-competition/non-solicitation agreements and compliance with the Fair Credit Reporting Act (FCRA) and other laws impacting employee background checks.
 
Mr. Tankle is also a member of the firm’s Higher Education Practice Group and provides litigation and counseling services to colleges and universities.
 
Tracey E. Diamond is of counsel with Pepper Hamilton LLP, resident in the Philadelphia office. Ms. Diamond practices in the areas of employment law, human resources counseling and employment litigation. She regularly counsels clients on workplace issues, provides harassment training, conducts internal investigations, drafts policies and procedures, negotiates employment and severance agreements, advises on independent contractor, FMLA and ADA compliance issues, and partners with clients to structure their workforce in the most efficient and effective way possible. Ms. Diamond vigorously defends clients before the Equal Employment Opportunity Commission, state administrative agencies and federal and state courts. She handles matters in the enforcement or defense of non-competition and non-solicitation clauses and defense against discrimination and harassment claims.
 
In the labor area, Ms. Diamond assists clients with negotiation of collective bargaining agreements and defense of grievances.
 
Ms. Diamond is also a member of Pepper’s Food and Beverage and Cannabis Industry groups and advises clients in these industries on their unique labor and employment needs, including workplace counseling, noncompete and labor union agreements.
 
Ms. Diamond is a New Jersey Superior Court Rule 1:40 qualified mediator and is included on the roster of court-approved mediators. Ms. Diamond previously served as an adjunct professor at Drexel University Kline School of Law.
 
Prior to joining Pepper, Ms. Diamond was director of human resources and operations for a not-for-profit charitable organization, where she was responsible for all human resources issues for more than 1,000 employees and contract administration for the agency’s union. She also was general counsel of a national retail optical company, where she oversaw the company’s employment law matters, negotiated commercial contracts and managed the litigation docket. Previously, Ms. Diamond served as a law clerk for a federal judge in the Southern District of New York, and also worked at several large law firms in New York City, Philadelphia and New Jersey.
 
Ms. Diamond is regularly called on to speak and write about a multitude of employment law issues. She is the editor of the Hiring to Firing Law Blog, Pepper's go-to resource for all human resources and employment law issues affecting the workplace – from hiring to firing.
