Description: Fingerprints, iris imaging, hand scans, and face geometry are no longer reserved for special agents. Today, employers use fingerprints to track employees’ hours, amusement parks collect thumbprints to prevent sharing of passes, social media sites capture facial images to “tag” people in photographs, retail stores implement similar facial scans to ban troublesome customers, and premier office buildings offer “wave of hand” biometric security access. Its use can increase security, convenience and efficiency, but it also creates significant legal risk, especially in Illinois. Illinois has the strongest biometric privacy law in the country, the Illinois Biometric Privacy Act (“BIPA”). Fearful of the potential abuses of biometric data—sensitive information that cannot be changed if compromised--the Illinois legislature included a private-right of action with statutory damages that can readily be combined in class-action litigation. Hundreds of putative class action lawsuits alleging BIPA violations are pending against employers and businesses.  And, the Illinois Supreme Court may have further opened the floodgates by ruling that no actual injury is required to assert a claim under BIPA. Practitioners must navigate BIPA by developing policies and procedures that minimize clients’ legal exposure. In this one-hour CLE, Ian H. Fisher and Gillian G. Lindsay of Hahn Loeser Parks LLP will explain the requirements of BIPA compliance, provide helpful practice pointers to minimize the risk of class-action litigation, and share practical advice on what to do when defending BIPA litigation.
