Description: In this program for all in-house and corporate counsel and litigators, Evan Singer and David Silva provide an in-depth discussion of issues to consider when conducting witness interviews for purposes of internal investigations or litigation. Topics include the potential application of attorney-client privilege (such as the Upjohn warning); practical tips and strategies for conducting the interview; and some post-interview considerations and strategies.

Evan P. Singer, Esq., a partner at Jones Day, focuses his practice on complex commercial and business litigation, as well as internal and government investigations. He has represented companies and their officers and directors in securities class actions, shareholder derivative actions, and proxy contests, as well as claims brought under the False Claims Act (FCA), and he has represented mortgage servicers in litigation and before various state attorneys general. In addition, Mr. Singer has extensive experience conducting internal investigations, including investigations into potential violations of the Foreign Corrupt Practices Act (FCPA). He has been named a "Texas Rising Star" by the editors of Texas Monthly (2010-2015).
David A. Silva, Esq. is an associate at Jones Day, where he has represented clients in civil, criminal, and regulatory disputes and regularly works on corruption and compliance matters arising under the Foreign Corrupt Practices Act. He has been involved in various aspects of commercial litigation and has experience conducting internal investigations, working in conjunction with the Department of Justice and the Securities and Exchange Commission. As a result of this experience, he frequently advises corporate clients on compliance, ethics, and data privacy matters.
