Description: The Federal Trade Commission (FTC), which is the primary federal regulator of most companies’ data privacy and security practices, has conducted more than 60 privacy and security-related enforcement actions in the last 15 years. David Zetoony and Josh James discuss what to expect and how to respond to a FTC investigation into a company's data privacy and data security practices.

David A. Zetoony, Esq. is a partner in the Washington, D.C. and Boulder, CO offices of Bryan Cave LLP. Mr. Zetoony is the leader of his firm's data privacy and security practice, and has extensive experience advising clients on how to comply with the advertising and data privacy rules and regulations of the Federal Trade Commission. He is an International Association of Privacy Professionals (“IAPP”) member, and he sits on the ABA Section of Antitrust Law’s Private Advertising Litigation Committee (former Vice-Chair); and the ABA Section of Antitrust Law’s Healthcare and Pharmaceutical Committee (former Consumer Protection Vice-Chair). He frequently speaks and writes on data security and privacy issues.
 
Joshua A. James, Esq. is an associate in the Washington, D.C. office of Bryan Cave LLP, where he is in the Antitrust and Competition group and a member of his firm’s Data Privacy and Security Team. His practice is focused on advising clients on complying with data privacy and data security regulations at both the state and federal levels. A member of his firm’s Data Breach hotline, Mr. James is also a member of the International Association of Privacy Professionals (IAPP). He is also a member of the firm Public Policy and Government Affairs group and he advises clients on compliance with federal election laws and regulations and federal and state lobbying laws and regulations.
