Description: As extensive construction projects and developments proceed throughout the New York-New Jersey metropolitan area, so do disputes between owners, general contractors, subcontractors and suppliers over project funds. Mechanic’s liens are a powerful tool for parties down the contracting chain to attempt to secure payment, but the strict statutory procedures involved are fraught with pitfalls. Moreover, there are critical differences between the NY and NJ Lien laws, of which attorneys and their construction-industry clients should be aware. This CLE program will provide an overview of the critical provisions of, and differences between, the New York and New Jersey lien laws, including the filing, service, priorities and prosecution of, or defenses against, mechanic’s liens filed in connection with public or private project, and commercial or residential properties.
