Join renowned toxicologist and expert James Wigmore and Justice Rick Libman of the Ontario Court of Justice for a discussion on the forensic aspects of alcohol in criminal and civil cases.

Topics to be considered include:

  1. Roadside Testing and Alcohol – a new generation of roadside testing devices and roadside suspensions; the capacity to measure alcohol at roadside rather than merely screen for pass, warn or fail; factors that may impact on accuracy of screening test such as recent alcohol consumption and residual mouth alcohol, other contaminants such as tobacco and drugs
  2. Breath Testing Machines and other ways of measuring alcohol – recent issues involving operation of breath testing equipment and accuracy of readings; evidence to the contrary; new generation breath testing devices and drug measuring devices; blood samples and urine tests as alternatives to breath samples
  3. Contributory Negligence and Impact of Alcohol in Civil Actions – effect of alcohol in motor vehicle cases due to slowness of reaction times, narrowing of peripheral vision; slip and fall cases involving alcohol consumption
  4. Expert Witnesses – how to find an expert witness on alcohol issues in criminal and civil cases, what to look for when interviewing an expert; how to prepare for trial; examining and cross-examining the expert witness

PRESENTERS:

James G. Wigmore
James G. Wigmore worked as a forensic alcohol toxicologist at one of the foremost laboratories in North America — the Centre of Forensic Sciences, in Toronto, Ontario — from 1976 until his retirement in 2005. He obtained his honors B.Sc. from the University of Toronto in 1980. He is a designated analyst under section 254(1) of the Criminal Code of Canada and was a member of the national advisory board, the Alcohol Test Committee (which advises the federal Department of Justice on breath and blood alcohol testing), from 1993 to 2005. Wigmore has testified in over 600 criminal trials at various levels of court as well as civil and coroner cases, and has published more than 50 articles in the field of forensic alcohol toxicology. He was the recipient in October 2005 of the most prestigious award of the Canadian Society of Forensic Sciences, the Derome Award, which recognizes outstanding contributions to the field of forensic science. In 2004, Wigmore became a faculty member of the Center of Studies for Law in Action, and he lectures at the Borkenstein Course at Indiana University in Bloomington, Indiana.

The Honourable Mr. Justice Rick Libman
Mr. Justice Libman was appointed to the Ontario Court of Justice in November, 1996. He is Chair of the Rules Committee of the Ontario Court of Justice. Justice Libman is the Associate Editor of Motor Vehicle Reports and co-author of Annotated Ontario Provincial Offences Act, Handling Provincial Offence Cases in Ontario, the Annotated Contraventions Act and is co-editor of the regulatory offences newsletter RegQuest.
