Description: This panel will survey options available to corporate victims of cyber hostilities with a focus on what responses are legal and ethical when implemented by private persons as compared to when law enforcement implements those same measures. It will also focus on lessons learned from companies' failed responses as well as ethical inefields for professional that practice in this area.  Areas the panel will cover include dealing with clients that would like to:
  • "hack back" or otherwise proactively investigate an adversary;
  • bury their collective head in the sand to avoid learning facts that could trigger a reporting obligation;
  • refuse to report a breach despite a legal obligation to do so;
  • silence a cybersecurity whistleblower who threatens to run to the SEC and report the breach
