This course is a practical guide to filing bankruptcy under Chapter 7, which provides an additional means of relief for small businesses. Participants may first want to view “A Guide to Small Business Reorganizations and Liquidations” or those with a basic understanding of the types of bankruptcy may choose to take it on its own.
In this course, a group of experienced professionals, including a federal bankruptcy judge, Chapter 7 trustee, and Chapter 7 lawyers discuss the fundamentals of a Chapter 7 bankruptcy liquidation, including eligibility to file (who and what), where to file, what happens when there are joint filings (including spouses and entities), the effects of filing (including the impact of the automatic stay and the formation of the bankruptcy estate), and exemptions to the bankruptcy estate (what are they and who gets them). They also explain the roles and duties of the Chapter 7 trustee, and what debtors, and their lawyers, can expect in a hearing before the bankruptcy judge. They also discuss post-bankruptcy relief from debts and the process of conversion from another type of bankruptcy to Chapter 7, and vice versa.
Who Should Attend
Like all of the programs in this Wake Forest Law/Thomson Reuters Small Business Bankruptcy series, this course is designed for and targeted at lawyers, small business owners, accountants, paralegals, and other experienced professionals who are new to bankruptcy and want practical, real-world advice from judges and practitioners to help them advise clients.
These presentations are designed as structured discussions among selected, practicing experts and other professionals. They will not just talk at you. They will talk among themselves and swap experiences and ideas to show how bankruptcy works generally and how it works differently depending on the client’s peculiar circumstances, needs, and interests.
