This course is an overview of the Small Business Reorganization Act of 2019 (Subchapter V of Chapter 11). This Act went into effect in February 2020, just before the COVID pandemic hit the US. This newest form of small business reorganization is increasingly important, and relief under the Act is intended to be faster, less expensive, and less bureaucratic than regular Chapter 11. Participants may first want to view “A Guide to Small Business Reorganizations and Liquidations” or those with a basic understanding of the types of bankruptcy may choose to take it on its own.

In this course, experienced bankruptcy practitioners and a Subchapter V trustee, along with two federal bankruptcy judges, explain who qualifies as a “small business debtor” under this newest form of small business reorganization. In addition, they discuss the eligibility requirements to file, as well as the how, what, and where of filing. The experts then provide a practical overview of the effects of the debtor’s filing Subchapter V bankruptcy, including the imposition of the automatic stay and the creation of the bankruptcy estate, as well as the administration of the bankruptcy case. The course concludes with an overview of the contents and confirmation of the debtor’s plan for repaying creditors.

Like all of the programs in this Wake Forest Law/Thomson Reuters Small Business Bankruptcy series, this course is designed for and targeted at lawyers, small business owners, accountants, paralegals, and other experienced professionals who are new to bankruptcy and want practical, real-world advice from judges and practitioners to help them advise clients.
