Beyond a recognition that we are seeing older attorneys in courts and on the bench, we are seeing record numbers of elderly people involved in the legal system due to increased drug and alcohol use, issues of competency, elder abuse, and increased rates of property crime. The elderly population has a greater incidence of cognitive impairment, higher rates of depression and organic psychosis than the general population. Yet they also have a greater degree of knowledge, specific expertise, and resiliency, recent studies show.
