Description: In recent years, U.S. and European Union (EU) regulators have been aggressively enforcing privacy laws, especially in the telecommunications and broadband Internet industries. This enforcement trend is coupled with the demise of a trans-Atlantic accord (the “EU Safe Harbor”) that had governed cross-border privacy protections for international transfers of personal data, and is now being replaced by the so-called “Privacy Shield.” It has also spurred an increase in private class actions for privacy violations. Privacy compliance (and potential liability) will become still more complex, both in the U.S. following the Federal Communications Commission’s release of new privacy regulations and, in the EU, with the General Data Protection Regulation scheduled to take effect in May, 2018.
Part I: Compliance of this three part series will examine privacy compliance and governing authority in both the U.S. and EU, including an overview of the FCC’s new privacy laws, data breach notifications, and the EU’s General Data Protection Regulation (GDPR) (including anticipated changes following the U.S. election).
