Description: There is an often misunderstood intersection between the law governing letters of credit or an undertaking of payment by a bank, bills of lading, and the increasing use of letter of credit real estate and trade financing, with the emphasis on bills of lading in trade deals as the prime documents required.  This informative 1-hour program will provide clarity in defining and categorizing letters of credit, bills of lading and drafts and the practical issues involved in their daily usage.

  Topics to be discussed include:
- Body of case law and applicable laws
- Domestic (Canadian) and international usage
- Stop payment on a Letter of Credit
- Refusal to pay based on discrepancies
- Effect of fraud in the transaction
- Effect of bankruptcy of the debtor
- Exemption of liability clauses in the Bill of Lading

Presenter:
Lazar Sarna practices in the fields of commercial, corporate and general litigation at Sarna Neudorfer s.e.n.c. in Montreal, Quebec.  He is the author of numerous books including Letters of Credit (Carswell, 3rd edition), the newly published Bills of Lading (Carswell), and the upcoming text The Law of Cheques and Promissory Notes.
