This informative year in review session will cover the most recent decisions of the US Supreme Court and highlight what new developments to expect out of the courts in the upcoming Term. Learn how these decisions will impact the advice you provide to clients.
Looking back at the 2011-12 Term, the panel will review the U.S. Supreme Courts employment decisions, which tilted towards employers, including interpreting the FLSA outside salesperson exemption, narrowing of the FMLA for public sector employees, and applying the ministerial exception under the ADA. There is also be a focus on the employment provisions of the Affordable Healthcare Act following the Supreme Courts June ruling upholding the statute.
Looking ahead, the panel will provide a preview of what is on the Supreme Court docket in the upcoming year. Topics include issues of affirmative action, class actions, Title VII liability and the Defense of Marriage Act. In addition, it will take a look at what the SJC will be hearing, including issues under the Wage Act, the MCADs jurisdiction over out-of-state employees, associational discrimination, and arbitration awards.
