The Leahy-Smith America Invents Act made sweeping changes to U.S. patent law, with different provisions taking effect between the September 16, 2011 date of enactment and March 16, 2013, when the final changes will be implemented. On September 16, 2012, the second significant wave of provisions took effect, bringing changes to patent prosecution and creating new proceedings to strengthen or challenge granted patents. This program will provide an overview of the most significant changes that just took effect, and identify strategies for taking advantage of the new law and positioning your company to benefit from the new proceedings.

Particular provisions discussed will include:

• New ability for an assignee to file and prosecute U.S. patent applications
• Revisions to the inventor oath/declaration requirements
• Expanded ability of third parties to submit prior art during prosecution
• New supplemental examination for strengthening patents
• New inter partes review proceedings for challenging patents
