Description:
The economy has had many effects on divorced families. Unemployment has forced people to look outside the Commonwealth for a job in order to increase marketability. On the other side of the coin, increased fuel prices have made it more expensive and burdensome for parenting plans that include significant travel, whether it be between states or within the state.
Further, increased instances of joint parenting arrangements will likely cause an increase in the application of the Mason case, as opposed to the Yannas standard. It is important to know the difference.
Removal actions are fact and case law driven. They will almost always go to trial and require very specific evidentiary support. This program will review the various standards involved in removal actions and will explore factual situations that will meet those standards through the use of hypotheticals. The program will also explore whether and how to utilize a Guardian ad Litem in a removal action.
