This presentation will address Rule 412 of the Federal Rules of Evidence -- the Rape Shield Provision-- surveying the four basic types of rape shield statutes currently in use. Beginning with a brief history of rape shield law, Ms. Roseberry will explain the rationale behind it and the congressional debate before moving into exceptions to the four types of statutes, citing to common law and statutory exceptions. Skills-based information including, pleadings, arguments, time limitations and ethical obligations will be provided, as will examples of successful use of the rape shield exception, and transcripts from the Kobe Bryant case.

The neighborhood where Cynthia Roseberry was reared provided tremendous opportunity for her to observe the criminal justice system at work. The desire to right the wrong she observed and to give a voice to those who were silenced ushered her into a legal career. After practicing Federal and State Criminal Defense for ten years, she joined the faculty at DePaul University College of Law. At DePaul, Roseberry taught Advanced Criminal Procedure. She also founded the Misdemeanor Clinic and her third year students never lost a trial. Her greatest joy was to teach new lawyers to seek careers in public interest law and to adopt a client centered philosophy of representation. A much sought after speaker, Roseberry travels across the nation giving talks related to criminal law, as a faculty member of the National Criminal Defense College, the William Daniel Trial Program, the Clarence Darrow Death Penalty College and the Federal Defender Trial Skills Academy. She currently serves as the Executive Director of the Federal Defenders of the Middle District of Georgia, Inc.
