Description: Both the Massachusetts Uniform Probate Code and the Massachusetts Uniform Trust Code contain provisions that will affect the administration of trusts. While the majority of these provisions can be overridden by the terms of the trust instrument under the Massachusetts Uniform Trust Code, this is less clear under the Massachusetts Uniform Probate Code. This program will be a roundtable discussion of various provisions that practitioners may want to consider in drafting trusts and/or may want to discuss with their clients.
