This program will explore how the recently amended homestead law appears to have affected the non-occupying debtor-spouse's rights to claim a homestead in his or her interest in the marital property. Speakers will provide a review of pre-amendment cases and post-amendment statutory language regarding the rights of the non-occupying spouse, and will discuss the impact these cases and the statute may have on the separated or divorcing spouse's decision on whether and when to seek bankruptcy protection.
