Description: This program will discuss the situations in which a judge may be required to disqualify because a member of the judges family is an attorney with some relationship to a case or the attorneys appearing in a case. It will consider what level of involvement in a case by a family member triggers disqualification and whether there are any exceptions to the rule. It will also examine whether disqualification is required when a family member is not appearing in a case but is a partner or associate in a law firm in the case. The program will also cover disqualification issues when a family member is a prosecutor, public defender, or an attorney for legal aid and other members of that office appear before the judge. Finally, the program discusses whether family members can appear before a judges colleagues.
