This course is a practical guide to family farm bankruptcy under Chapter 12, featuring one of two primary authors of the Act, The Honorable Thomas A. Small (Retired) United States Bankruptcy Judge, Eastern District of North Carolina. Chapter 12 allows eligible family farmers and family fisheries to adjust their debts while they retain control and possession of their property and the ability to operate their farms. Participants may first want to view “A Guide to Small Business Reorganizations and Liquidations” or those with a basic understanding of the types of bankruptcy may choose to take it on its own.
 
The experts, including federal bankruptcy judges and Chapter 12 practitioners and farm owners, discuss the rationale, history, and role of Chapter 12. They also explain who is eligible for relief under Chapter 12, as well as the effects of the farm-debtor’s filing, including the imposition of the automatic stay, the creation of the bankruptcy estate, and the administration of the bankruptcy case. Their discussion also introduces the debtor’s plan of reorganization – the contents, judicial confirmation, and discharge after plan performance.

Like all of the programs in this Wake Forest Law/Thomson Reuters Small Business Bankruptcy series, this course is designed for and targeted at lawyers, small business owners, accountants, paralegals, and other experienced professionals who are new to bankruptcy and want practical, real-world advice from judges and practitioners to help them advise clients.
