This course is a practical guide to sole proprietors considering filing bankruptcy under Chapter 13. Chapter 13 provides an additional means of relief for a business operating as a sole proprietor. Participants may first want to view “A Guide to Small Business Reorganizations and Liquidations” or those with a basic understanding of the types of bankruptcy may choose to take it on its own.
 
In this course, a group of experienced professionals, including a federal bankruptcy judge, Chapter 13 trustee, and Chapter 13 lawyer, compare the statutory strategies, practical implications, and goals of a debtor in bankruptcy under Chapter 13 vs. Chapter 7. They also discuss: (1) filing eligibility; (2) the how, what, and where of filing; and (3) the administration of the Chapter 13 bankruptcy case. In addition, they provide insights and strategies for preparing and confirming a Chapter 13 plan, as well as the debtor’s performance under the plan.

Like all of the programs in this Wake Forest Law/Thomson Reuters Small Business Bankruptcy series, this course is designed for and targeted at lawyers, small business owners, accountants, paralegals, and other experienced professionals who are new to bankruptcy and want practical, real-world advice from judges and practitioners to help them advise clients.
