Description: Framework and Ethics of International Criminal Law
In addition to being a substantive introduction to ICL I have tried to frame this CLE so that it meets the requirements for Ethics and Elimination of Bias credits. A similar CLE event a year ago on the Nuremberg legacy was very successful, so while not quite that scale (we had a film, and one of the lawyers involved in the trials here) it may attract some similar interest.
This CLE provides an introduction to specialist studies in international criminal law, that is, the body of law regulating individual criminal responsibility under international law. The course covers the history and development of international criminal law and the establishment, jurisdictions and activities of the International Criminal Court, as well as ad hoc criminal tribunals. The moral dilemmas of addressing atrocity crime will be explored as well as the trade-offs involved in pursing selective prosecutions in states where there is limited capacity and infrastructure to advance accountability. In that context, the jurisprudence of various international criminal tribunals, from the Nuremberg Tribunal to the International Criminal Court situated in The Hague will be integrated into the materials presented. The course will address the material, mental and contextual elements of the three 'core crimes' - genocide, crimes against humanity and war crimes. A particular emphasis on gender crimes under the International Criminal Law system will be undertaken as well as examining the particular ethical challenges of prosecuting sexual violence crimes following armed conflict and repression. The course will address the core principle of complementarity and cooperation in international criminal matters and include selected conceptual and institutional critiques of the international criminal justice 'project'.
