Description: Daniel Foster and Christopher Bright address recent developments in Section 337 investigations at the U.S. International Trade Commission, including key developments on the substantive issues of direct infringement, indirect infringement, validity, domestic industry, and the scope of exclusion orders, as well as key procedural issues, including the 100-day pilot program and stays pending the completion of Inter Partes Reviews. 
 
Daniel R. Foster, Esq. is a partner in the law firm of McDermott Will & Emery LLP, based in its Orange County office. Mr. Foster, who serves as the partner-in-charge of the Orange County office, litigates and tries complex intellectual property and other commercial cases, and advises companies on licensing issues and pre-litigation strategy and planning. He has experience in domestic and international intellectual property disputes in a wide variety of technologies, and has litigated over 50 patent cases in a number of district courts and before the International Trade Commission. Mr. Foster specializes in patent damages and has also lectured in a number of areas relating to patent damages.
 
Christopher D. Bright, Esq. is a partner in the law firm of McDermott Will & Emery LLP, based in its Orange County office. Mr. Bright litigates and tries U.S. patent cases and counsels clients regarding U.S. patents and has extensive experience with complex patent litigation, including more than 50 U.S. patent cases and multinational patent disputes. He has successfully tried numerous patent cases, examining both expert and fact witnesses at trial, and arguing at patent claim construction hearings. He has also argued before the Board of Patent Appeals and Interferences in the U.S. Patent and Trademark Office.
