Description: California’s Financial Elder Abuse act was recently updated to provide a new definition for undue influence. This definition applies both to Trust and Will contests, where undue influence can be used to overturn a Trust or Will, and in establishing Financial Elder Abuse. This course will discuss creative ways in which to use a Financial Elder Abuse claim in your Trust or Will contest case, how the new definition affects undue influence claims, some of the advantages gained by parties bringing a Financial Elder Abuse claim and practical tips on procedural advantages to filing a Financial Elder Abuse in conjunction with a Trust or Will contest.
Presenters for this program are attorneys Keith Davidson and Stewart Albertson of Albertson & Davidson LLP. Keith and Stewart author the California Trust, Estate & Probate Litigation blog.
