Consumers continue to share ever-increasing amounts of personal data with the companies they do business with. As these firms continue to find new uses for such data, regulators and the courts have stepped in to ensure the protection of this personally identifiable information. 47 states, as well as a number of US territories, have passed data breach notification laws governing company responsibilities in the wake of a data breach. By analyzing the two most recently enacted data breach notification laws—Florida’s Information Protection Act and Kentucky’s H.R. 232—this webinar provides general and outside counsel a sense of the obligations imposed on companies that maintain consumer data. Additionally, the panel discusses a number of recent court decisions stemming from recent breaches to determine whether the tide may be shifting in favor of data-breach plaintiffs. Finally, the panel provides a number of boots-on-the-ground, practical strategies for both mitigating risk before a data breach and effectively addressing a breach when it occurs.

Eric S. Boos (moderator/panelist)
Eric is an attorney in Shook, Hardy & Bacon LLP’s Miami office. His practice focuses on complex commercial litigation, including privacy and data security, unfair competition, and all forms of intellectual property protection. Eric regularly assists his clients with the identification and mitigation of data security risks and the preservation of information systems integrity, drafting consumer privacy policies, monitoring industry-specific regulatory requirements for sensitive data, designing effective data breach response protocols, managing regulatory inquiries, and protecting intellectual property rights.
 
Jamie Crabtree (panelist)
Jamie is  an  Attorney with a comprehensive background in global privacy, data security and compliance program management.  She has worked for large data providers, including CoreLogic and Equifax, where she was responsible for legal oversight of cyber-security programs and a member of incident response teams.
 
Christopher Burgio (panelist)
Christopher Burgio, Vice President, leads the Technology and Life Science Industry Team at Marsh & McLennan Agency. He works with Florida-based market leaders and emerging technology companies providing software, hardware engineering and manufacturing, clean technology manufacturing and installation, healthcare IT, and information services.
