Description: When the agent binds the insurer to an unacceptable risk, does the agent owe a duty to indemnify the insurer? When an authorized agent is wrongly sued by the insured, does the insurer have a duty to indemnify the agent’s defense costs? These issues of cross indemnity between insurers and agents arise frequently in agents E&O litigation, either as crossclaims in the E&O case itself or as derivative claims. Yet the legal standards for these indemnity claims are not entirely clear in all states. What should the law be? In addition to the lack of legal clarity, indemnity claims often create a conflict between the agent and insurer, in E&O litigation where they would like to retain a united front. How is this best managed? This CLE provides an overview of the legal standards for indemnity between agents and insurers. It also provides practical tips on resolving these important claims without breaking the united front in the E&O case.
