Description:
With sanctions for spoliation of evidence increasing 271% since 2005, it is more important than ever for a corporation to have an established, defensible and efficient legal hold policy. Even in corporations that don’t see a lot of litigation, it’s critical to have a well-documented and sound methodology for sending hold notifications and reminding custodians about their ongoing legal obligations.

To be most effective, a legal hold policy must assure that your hold notifications will stand up under scrutiny if challenged. As such, the policy should:
  • Reduce risk and increase defensibility
  • Guarantee that holds are issued in a timely fashion and contain all necessary information
  • Create an efficient method for identifying and notifying custodians and other key players
  • Outline a standard set of data/content types (both print and electronic) to be preserved; this list should be reviewed and updated periodically as new types of data (e.g. social media)
This session will discuss what your corporation should consider when creating a policy that aligns with these goals and offer practical advice for establishing a defensible legal hold process.
