With sanctions for spoliation of evidence increasing 271% since 2005, it is more important than ever for a corporation to have an established, defensible and efficient legal hold policy. Even in corporations that don’t see a lot of litigation, it’s critical to have a well-documented and sound methodology for sending hold notifications and reminding custodians about their ongoing legal obligations.
To be most effective, a legal hold policy must assure that your hold notifications will stand up under scrutiny if challenged. As such, the policy should:

Guarantee that holds are issued in a timely fashion and contain all necessary information
