Description:
Disney renews its multi-million dollar motion picture output deal with Netflix instead of Starz?  Big-budget Hollywood drama House of Cards plays exclusively on Netflix and not on television?  Independent film Arbitrage earns millions from “premium VOD” rentals by going “day and date” with its theatrical release?  
 
This program guides attorneys through these and other recent developments in the licensing of digital rights in television and film content and highlights many of the key legal and business issues that arise in digital rights licenses.  Topics include:
 
  • Update on the state of digital rights in television and film licensing;
  • Review of traditional, i.e., pre-digital rights, business models;
  • Overview of digital business models;
  • Discussion of key issues and license terms in “home entertainment” digital rights licenses (i.e., Electronic-Sell-Through [EST] and Transactional Video-On-Demand [TVOD]); and
  • Discussion of key issues and license terms in all other digital rights licenses (i.e., Free Video-On-Demand [FVOD], Advertiser Supported Video-On-Demand [ADVOD] and Subscription Video-On-Demand [SVOD]).

Zach McGee is Senior Vice President, Head of Business & Legal Affairs, for Miramax in Santa Monica where he oversees all licensing of Miramax’s television and film content in digital and traditional media throughout the United States and the rest of the world.  Before joining Miramax, Mr. McGee was a Vice President, Legal Affairs at NBCUniversal where he was responsible for license agreements and talent contracts for programs produced for NBCUniversal’s broadcast and cable television networks.  He also has extensive litigation experience, having practiced as an in-house litigator at NBCUniversal, and before that, as a securities and M&A litigator with Davis Polk & Wardwell in New York, and Menlo Park, California.  He graduated magna cum laude from Harvard College and Harvard Law School, and clerked for the Honorable Michael B. Mukasey, Chief Judge, U.S. District Court for the Southern District of New York.  Mr. McGee is the President and a Co-founder of New Media Legal Publishing, Inc. in Los Angeles, and a frequent author and speaker on topics of interest to in-house and law firm lawyers.
