Contractors expend a considerable sum to ensure that they have general liability insurance, but all too often in construction defect cases (often with millions of dollars in potential damages on the line) the insurer denies coverage based on business risk exclusions in the policy. Likewise, design professionals face coverage issues in these cases. The insurance coverage panel will focus on coverage, current case law related to "business risk" exclusions to coverage for construction defect claims, and how to address them in the context of a dispute.
Attendees will also receive feedback as to what drives sureties to provide bonding, how contractors obtain bonding, the legal relationship between sureties, their principals, and third parties, and how that relationship plays out in litigation.
