Georgetown Law CLE and the American Bankruptcy Institute (ABI) have joined forces to bring you Bankruptcy 2012: Views from the Bench. This comprehensive one-day program features many U.S. Bankruptcy judges from the across the country, with judges populating every panel. The judges are joined by practitioner-facilitators and moderators who drive the discussions. This program provides you with a unique opportunity to interact with judges in a one-one-on networking environment, in a safe forum where you can get your questions answered, and in a law school setting where learning is the paramount goal.
In Part One:
-Panelists discuss sales and executory contracts and how far the courts are going under current law, including sales involving IP and patent licenses, and if Precision Industries are alive and well.
- Panelists compare In re Bellingham with In re Direct Response Media Inc., and decide if Stern should be applied under a broad or narrow interpretation.
-Panelists comment on how TOUSA has changed the legal standard for what is reasonably equivalent value, the fate of affiliate guarantees, and if lenders now need to investigate the use of loan proceeds.
