1:45 – 3:15 pm Session 1: Future of Capacity Markets

The landscape of resource selection has changed dramatically over the last decade. As fuel-neutral markets do not necessarily support the zero-carbon resources in the manner desired by state executives and legislatures, laws have been enacted directing the procurement of certain resources and programs. These have focused on zero emission credits for nuclear plants, energy efficiency, solar power, and offshore wind. As states have increased the levels of these procurements to meet either 100% renewable, carbon neutral or targets with dramatic carbon reductions (some as early as 2030), the exclusion of these procurements from ISO/RTO capacity market payments has led some states, including IL, MD, NJ, NY and CT to examine use of ISO/RTO capacity markets or in one case, participation in the RTO. The discussion focuses on the turning point we find ourselves at in 2020 and will include perspectives re: where states want to go in procuring the resources they desire to meet policy objectives; how markets may still be used to achieve various resource and policy objectives; and activity in the Courts of Appeal that will either endorse or reject recent FERC actions expanding limitations on the participation of state-sponsored resources in capacity markets.
