Treasury Proposal: Undisclosed Benefits and Risks of Buying Mortgage-Related Assets

EAGAN, Minn., Sept. 25, 2008 – As Congress considers a proposal for a $700 billion bailout of major lenders in an effort to stabilize the United States economy, many attorneys and their clients who have a stake in the mortgage and asset-related securities market are researching the Treasury Department’s proposal and its potential impact.

West LegalEdcenter and West Legalworks, part of West, have produced a free white paper and webcast to help make sense of the complex nature of mortgage-backed securities, the rights the government will have if it purchases them and an up-to-the minute status report of where the legislation stands before Congress.

The white paper, just posted to West LegalEdcenter, was written by Talcott J. Franklin, co-author of the Mortgage and Asset Backed Securities Litigation Handbook, published by West. Franklin is a partner and head of litigation in the Dallas office of Patton Boggs LLP.

“Make no mistake: the situation is dire, more so than many wish to acknowledge and perhaps worse than any of us can imagine,” writes Franklin. “I have pressed some of the nation’s top economists and analysts on what the world will look like if our financial institutions continue to collapse, and the most descriptive answer I receive is that things will be ‘really bad.’ It is a situation without precedent.”

The live webcast, titled “Bailout or Washout: An Analysis of the Treasury Proposal to Purchase Mortgage-Related Assets,” will take place Monday, Sept. 29, from 1 p.m. to 2 p.m. Eastern.

The webcast will feature Franklin, the Hon. Chris Bell – a former member of Congress and member of the House Financial Services Committee – and Thomas F. Nealon, Franklin’s co-author of the Mortgage and Asset Backed Securities Litigation Handbook. Nealon is general counsel of LNR Partners, Inc.

Registration for the live webcast is limited. It is available for credit in more than 40 jurisdictions. The details page for the program has more information on eligibility, including status of accreditation for this program. States not listed are not eligible for credit.
